1. Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the IA Agent REIC platform operated by Francesc LLC ("we", "us", or "our"). By accessing or using our service at francesc.cc and related subdomains, you agree to be bound by these Terms.

3. Account Registration & Eligibility

Eligibility Requirements:

  • You must be at least 18 years old
  • You must provide accurate and complete information
  • You must have legal capacity to enter into agreements
  • You must comply with all applicable laws and regulations

Account Responsibilities:

  • Maintain the security of your login credentials
  • Notify us immediately of any unauthorized access
  • You are responsible for all activities under your account
  • Do not share your account with others

Billing Terms:

  • Payment Processing: All payments processed securely through Stripe
  • Recurring Billing: LandKing subscriptions renew monthly automatically
  • Cancellation: Cancel anytime; access continues until end of billing period
  • Refunds: No refunds for partial months; service available until period ends
  • Price Changes: 30-day advance notice for subscription price changes

5. Acceptable Use Policy

Permitted Uses:

  • Personal or business real estate investment analysis
  • Educational and research purposes
  • Legitimate property portfolio management

Prohibited Activities:

  • Attempting to reverse engineer or copy our algorithms
  • Using automated tools to scrape or extract data
  • Creating multiple accounts to circumvent usage limits
  • Sharing account credentials or subscription access
  • Using the service for illegal or fraudulent activities
  • Attempting to disrupt or compromise our systems

6. Intellectual Property Rights

Our Rights:

All algorithms, software, designs, trademarks, and content are owned by Francesc LLC and protected by intellectual property laws.

Your Data:

You retain ownership of your property data and calculations. We have a limited license to process and store this data to provide our services.

License to Use:

We grant you a non-exclusive, non-transferable license to use our service according to these Terms and your subscription level.

7. Privacy & Data Protection

  • Francesc LLC's total liability is limited to the amount paid for your subscription in the 12 months preceding the claim
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • We are not responsible for investment losses based on our tools or recommendations
  • Users are solely responsible for their investment decisions and outcomes

10. Termination

Your Rights:

  • Cancel your subscription anytime
  • Delete your account and data
  • Export your data before termination

Our Rights:

  • Suspend accounts for Terms violations
  • Terminate service with 30-day notice
  • Remove content that violates policies

Data Retention: After termination, we retain your data for 30 days for recovery purposes, then permanently delete it (except as required by law).

11. Governing Law & Disputes

These Terms are governed by the laws of New Mexico, United States.

Dispute Resolution:

  1. Direct Contact: Contact us first at sales@francesc.cc to resolve disputes
  2. Mediation: If unresolved, disputes may be submitted to mediation
  3. Arbitration: Final disputes subject to binding arbitration in New Mexico
  4. Class Action Waiver: No class action lawsuits permitted

12. Changes to Terms

We may update these Terms from time to time. We will notify you by:

  • Posting updated Terms with a new "Last updated" date
  • Email notification to registered users for material changes
  • In-app notification for significant modifications

Continued use after changes constitutes acceptance of the new Terms.
